1. Who runs VivahMandi
VivahMandi is operated by [[FILL IN: registered entity name]] (CIN [[FILL IN: CIN]]), registered office at [[FILL IN: registered address]], India (“VivahMandi”, “we”, “us”). By accessing or using VivahMandi (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. Description of service
VivahMandi is an online B2B marketplace for used wedding and event equipment — sound & audio, lighting, LED & visual, staging & truss, tenting & structures, mandap & decor, furniture and catering equipment — serving trade professionals: planners, decorators, tent houses and production houses. We provide the platform, escrow, verification and dispute resolution for transactions between buyers and sellers; we do not own, buy, or sell the items listed, and title to an item passes directly between buyer and seller.
3. User accounts
- You must be at least 18 years old, and act on behalf of a genuine business or trade professional, to create an account
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete information when registering, including any GSTIN and KYC details required for seller verification
- One person may not maintain multiple accounts to evade fees, bans or verification
- We reserve the right to suspend or terminate accounts that violate these terms
4. Seller requirements
- Sellers must complete GSTIN/KYC verification before listing items
- All listings must accurately describe the item’s condition, using the platform’s condition-grading scale and required photos/documentation
- Counterfeit, stolen or non-compliant equipment (e.g. gensets, wiring or rigging hardware that doesn’t meet applicable safety standards) is strictly prohibited
- Sellers must ship or hand over items within the promised timeframe and provide tracking information
- Sellers are responsible for their own GST registration, invoicing and income-tax compliance. As required under Section 52 of the CGST Act, VivahMandi (as the e-commerce operator) collects Tax Collected at Source (TCS) on the value of each sale, withholds it from the seller’s settlement, and remits it to the government on the seller’s behalf — it is not an extra cost we simply pass on for the seller to separately pay
5. Buyer responsibilities
- Review listing details, condition grade and photos/documentation carefully before purchasing
- Provide accurate delivery information
- Inspect the item promptly at delivery, during the inspection window stated on your order
- Raise a dispute within the inspection window if the item doesn’t match the listing — after that window, or once you confirm receipt, the sale is treated as final and escrow releases to the seller
6. Fees, payments and escrow
Buyers pay the listed price — VivahMandi does not add a buyer markup. Sellers pay a tiered success fee only when an item sells (0% for founding vendors through 31 December 2026, after which standard tiered rates apply as published in your seller dashboard). Listing an item is always free.
Payments are processed by our payment partner, Cashfree, and held in escrow. Once an order is marked delivered, the buyer has a stated inspection window to confirm the item or raise a dispute; if the buyer confirms, or the window elapses without a dispute, escrow releases and the seller is paid out — net of the success fee, payment processing charges, and any TCS/TDS withheld under applicable tax law. Listed prices are GST-inclusive; a tax invoice is generated for each completed sale.
7. Disputes and refunds
If an item doesn’t match its listing, buyers can open a dispute during the inspection window, with a description and supporting evidence (photos, etc.). We review the listing, the seller’s dispatch documentation, and evidence from both parties, and make a resolution decision — including a full or partial refund where warranted. 8. Prohibited activities
- Selling counterfeit, stolen, unsafe or illegal items
- Misrepresenting item condition, authenticity, or ownership
- Circumventing platform fees through off-platform transactions initiated from a VivahMandi listing
- Harassment or abuse of other users
- Creating fake accounts, listings, or reviews
- Any form of fraud or deception
9. Intellectual property
The VivahMandi name, logo, and platform design are our intellectual property. Users retain ownership of the content they upload (listing photos, descriptions) but grant us a license to display and use it on the Platform for the purpose of operating the marketplace.
10. Limitation of liability
VivahMandi acts as an intermediary providing escrow, verification and dispute resolution — we are not the manufacturer, owner or seller of any item listed, and we are not liable for a listed item’s quality, safety or legality beyond our stated verification and dispute process. Our liability in connection with the Platform is limited to the fees we actually received on the transaction giving rise to the claim, except where liability cannot be limited under Indian law.
11. Governing law & dispute resolution
These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms or the Platform will be subject to the exclusive jurisdiction of the courts at [[FILL IN: city of registered office]], India, without prejudice to any dispute-resolution process described in our Refund Policy or Seller Agreement.
12. Changes to terms
We may update these terms from time to time. We will post the revised terms here with an updated “last updated” date; continued use of the Platform after changes take effect constitutes acceptance of the new terms.
